YOUR USE OF THE AMERICAN LEGACY MEDIA WEBSITE AND THE CONTENT CONTAINED HEREIN CONSTITUTES YOUR AGREEMENT TO BE BOUND BY THESE TERMS AND CONDITIONS OF USE.
Ownership and Binding Terms and Conditions. This website (AmericanLegacyMedia.com) is owned and operated by American Legacy Media ("ALM"), a private company located in Clinton, Utah, USA. The following "Terms" set forth the terms and conditions under which you may use our website and services. This website offers visitors access to special offers on our books, as well as information about upcoming titles, authors, and prospective authors. By accessing or using this website, you agree that you have read, understood, and agree to be bound by these Terms.
Scope. These Terms govern your use of the website and any purchases made through it. They do not govern the relationship between American Legacy Media and its publishing authors, which is set out separately in each author's written publishing agreement. In the event of any conflict between these Terms and a signed author agreement, the author agreement controls.
Usage. In order to use our website and/or receive our services, you must be at least 13 years of age, or the legal age of majority in your jurisdiction, and possess the legal authority, right, and freedom to enter into these Terms as a binding agreement. You may not use this website and/or receive services if doing so is prohibited in your country or under any law or regulation applicable to you.
Limitations on Use. Unless otherwise agreed by you and ALM in a separate written agreement, the content on the website is for your personal use only and not for commercial use or misuse. You may not use the website or its content for any illegal purpose, or in any way inconsistent with these Terms. You may not recompile, decompile, reverse engineer, disassemble, rent, lease, loan, sell, sublicense, or create derivative works from the ALM website or any of its content. You may not use any network monitoring or discovery software to determine the website's architecture or to extract information about usage, individual identities, or users. You may not use any robot, crawler, scraper, spider, other automated software, recording device (including a camera), or manual process to copy or inspect the website or its content. You may not use the website to transmit any false, misleading, fraudulent, or illegal communications. You may not reproduce, duplicate, replicate, or distribute content from this website for commercial, noncommercial, or public purposes, or in any manner that could compete with the business of ALM. You may not otherwise repurpose any portion of this website or its content in violation of the export control laws and regulations of the United States. Any unauthorized use of the website or its content is prohibited.
Purchase Agreement. When buying an item, you agree that: (i) you are responsible for reading the full item listing before committing to buy it; and (ii) you enter into a legally binding contract to purchase an item when you commit to buy it and complete the checkout payment process.
The prices we charge for our products are listed on the website. We reserve the right to change prices at any time and to correct pricing errors that may inadvertently occur. Additional information about pricing and sales tax is available on the payments page.
Shipping and Returns. Shipping and returns are governed by our Shipping & Returns Policy, which is incorporated into these Terms by reference.
Service Changes. We may, without prior notice, change the services, stop providing the services or any features of the services, or create limits for the services. We may permanently or temporarily terminate or suspend access to the services without notice or liability for any reason, or for no reason.
Ownership of Intellectual Property, Copyrights, and Logos. The service and all materials therein or transferred through it, including without limitation software, images, text, graphics, logos, patents, trademarks, service marks, copyrights, photographs, audio, video, music, and all related intellectual property rights, are the exclusive property of American Legacy Media. Except as explicitly provided herein, nothing in these Terms creates a license in or under any such intellectual property rights, and you agree not to sell, license, rent, modify, distribute, copy, reproduce, transmit, publicly display, publicly perform, publish, adapt, edit, or create derivative works from it.
Right to Suspend or Cancel User Access. We may permanently or temporarily terminate or suspend your access to the service without notice or liability for any reason, including if, in our sole determination, you violate any provision of these Terms or any applicable law or regulation. You may discontinue use and request to cancel your account and/or any services at any time. Notwithstanding the foregoing, with respect to automatically renewed subscriptions to paid services, such subscriptions will be discontinued only upon the expiration of the period for which you have already paid.
Indemnification. You agree to indemnify and hold ALM harmless from any demands, loss, liability, claims, or expenses (including attorneys' fees) made against us by any third party arising out of or in connection with your use of the website or any of the services offered on it.
Limitation of Liability. To the maximum extent permitted by applicable law, in no event shall ALM be liable for any indirect, punitive, incidental, special, consequential, or exemplary damages, including without limitation damages for loss of profits, goodwill, use, data, or other intangible losses, arising out of or relating to your use of, or inability to use, the service.
To the maximum extent permitted by applicable law, ALM assumes no liability or responsibility for: (i) errors, mistakes, or inaccuracies of content; (ii) personal injury or property damage of any nature resulting from your access to or use of our service; or (iii) any unauthorized access to or use of our secure servers and/or any personal information stored on them.
Privacy. Your use of the website is subject to ALM's Privacy Policy.
Right to Change or Modify Terms. We reserve the right to modify these Terms from time to time at our sole discretion. You should review this page periodically. Your continued use of the website or our services after any such change constitutes your acceptance of the new Terms. If you do not agree to these Terms or any future version of them, do not use or continue to use the website or our services.
Email Communications and Consent. By providing your email address, you agree to receive promotional messages and materials from us by email from time to time. You may opt out of email communications at any time using the unsubscribe link in any email or by contacting us.
Phone and Text Message Consent. If you separately provide your phone number and affirmatively opt in, we may contact you by phone call or text message with order updates or promotional offers. Message and data rates may apply. You may opt out of calls or texts at any time by replying STOP to any text message or by contacting us. We do not sell or share phone numbers with third parties for their own marketing purposes.
Disputes. These Terms, the rights and remedies provided under them, and any claims or disputes related to them and/or to the services, shall be governed by, construed under, and enforced in accordance with the internal substantive laws of Utah and the United States, without regard to conflict of laws principles. Any such claims or disputes shall be brought exclusively in a court of competent jurisdiction located in Davis County, Utah, USA, and you consent to that jurisdiction. The application of the United Nations Convention on Contracts for the International Sale of Goods is expressly excluded.
